Vehicle Reverses onto Sidewalk Causing Pedestrian Injury
A car driven by George Chang backed up onto the sidewalk on Irving Street in San Francisco, striking L.K., a 72-year old man who was out shopping with his wife. The impact caused brain injury that left the man disabled and dependent on others. The car driver denied fault and contested the severity of the injuries and care L.K. would need.
Shortly before the trial date, Meisel filed a California Code of Civil Procedure Section 998 offer to compromise in the sum of 9-million-dollars. Defendant Chang accepted the compromise offer. Judgment was entered. Chang’s insurer, CSAA, paid their $500,000.00 policy limit. Collection proceedings were initiated which resulted in Chang paying the balance of the 9-million-dollar judgement.
